Homeland Security Secretary Markwayne Mullin has thrown new fuel on one of the most explosive controversies surrounding Democratic Rep. Ilhan Omar, declaring that federal authorities are investigating her immigration history and asserting that she married her brother in an effort to bring him into the United States.
The stunning comments came as Mullin discussed what he described as an active federal investigation into the Minnesota Democrat, whose personal immigration history has faced scrutiny and political controversy for years.
“We know that she married her brother to try to bring him into the United States,” Mullin said while speaking with conservative commentator Benny Johnson at the Republican National Convention in Dallas.
Mullin also said investigators are examining matters beyond the disputed marriage.
“There may be more to this, the whole family migration and possibly some illegal activity for them to come to the United States to begin with,” the Homeland Security secretary said.
That represents a significant escalation in the political battle surrounding Omar because Mullin is not merely another commentator repeating an allegation from the sidelines. He is the official overseeing the Department of Homeland Security while describing the matter as an ongoing investigation.
“This is an ongoing investigation,” Mullin said.
He further insisted that the investigation concerns potentially unlawful conduct rather than political disagreement.
“It’s an actual case because they did things wrong,” Mullin said.
For conservatives who have spent years demanding answers about Omar’s immigration and marital history, Mullin’s comments are likely to intensify demands for transparency and documentary evidence.
The key distinction, however, is that Mullin publicly asserted the marriage claim while DHS has not released records establishing that Omar’s former husband, Ahmed Nur Said Elmi, was her biological brother.
A DHS spokesperson declined to discuss the details of the investigation when contacted about Mullin’s remarks.
“As a matter of policy, DHS does not comment on specific investigative techniques, ongoing investigations, or potential future actions,” the spokesperson said.
The department nevertheless added a pointed reminder that congressional office does not provide immunity from the law.
“No one, including members of Congress, are above the law,” a DHS spokesman told JNS.
That statement will inevitably increase pressure on Omar and her allies as the investigation proceeds.
Omar has repeatedly denied the central allegation. According to the Yahoo report, she has rejected claims that Elmi was her brother and has dismissed accusations of immigration fraud as false.
When the allegations surfaced previously, Omar called them “lies.”
The dispute stretches back years. Omar legally married Elmi in 2009 after previously having a faith-based marriage with Ahmed Hirsi, according to earlier reporting carried by Yahoo. Omar and Elmi separated in 2011 but did not legally divorce until later.
Questions surrounding that timeline became a recurring source of controversy because public records raised inconsistencies about Omar’s relationships and living arrangements.
Yahoo previously reported that public documents pointed to unresolved questions about Omar and Hirsi during the period in which she remained legally married to Elmi.
Those inconsistencies fueled conservative suspicions, but earlier reporting also stressed that no birth certificate or other legal document had emerged publicly proving that Elmi was Omar’s brother.
That remains an important dividing line between an allegation under investigation and a proven finding.
Mullin’s latest statement dramatically raises the stakes because he claimed federal authorities know the disputed relationship existed, yet the government has not publicly released the evidence that would establish it.
“We know he lives now in London,” Mullin said of Omar’s former husband.
According to reporting on Mullin’s comments, federal investigators are examining whether there was possible illegal activity connected not only with Omar’s marriage but also with her family’s immigration history.
Mullin also rejected the suggestion that the investigation is simply a partisan attempt to target one of the most prominent progressive Democrats in Congress.
“When we move forward, it’s not political,” Mullin said.
That assertion will be closely watched. Omar has become one of the Democratic Party’s most recognizable progressive voices, making any federal investigation involving her an immediate political flashpoint.
For Trump supporters and immigration hawks, the controversy also presents a straightforward question of equal enforcement. If federal investigators possess evidence of immigration fraud, they will face intense pressure to make those findings public and pursue the case regardless of Omar’s position in Congress.
If investigators do not possess evidence proving the allegation, Mullin’s unusually definitive language will face scrutiny of its own.
As of the latest reports, no court has ruled that Omar committed immigration fraud, and DHS has not publicly released documentary evidence establishing that Elmi is her brother.
That means the strongest factual conclusion currently supported by the public record is not that DHS has formally proven the allegation, but that the secretary of Homeland Security says the department is actively investigating Omar and personally claims investigators know she married her brother.
