‘I Kept Being Cut Off’: Holdout Juror in the Lindsay Clancy Case Is Fighting Back

The lone juror whose refusal to accept an insanity verdict led to a mistrial in the Lindsay Clancy case is speaking publicly for the first time. He disputes fellow jurors’ claims that he expressed doubt about the prosecution’s case.

Michael P. Desronvil says he never wavered in his belief that prosecutors proved Clancy knew what she was doing when she strangled her three young children in January 2023. His statement is blunt: “I didn’t have any doubts.”

He also described how the deliberations felt from his seat. He said that when he tried to explain different theories, he kept being cut off as if he had doubts about the evidence.

He said the physical evidence, the key witnesses and the prosecution’s presentation were enough to show that Clancy knew exactly what she was doing and planned it.

His account directly contradicts other jurors. Fellow jurors said after the mistrial that he appeared to acknowledge reasonable doubt but still would not join the other 11 in finding Clancy not guilty by reason of insanity.

The jury deadlocked 11 to 1, with Desronvil alone in favor of convicting rather than accepting the insanity defense, and Judge William Sullivan declared a mistrial. That came after seven days of deliberations and a dramatic fight over the holdout juror.

The facts of the killings are not disputed. Clancy, a former labor and delivery nurse, admitted killing her children Cora, 5, Dawson, 3, and Callan, 8 months.

The trial turned on her state of mind. The defense argued she was not criminally responsible because of severe mental illness at the time. Prosecutors argued she planned the killings and understood that her actions were wrong.

Deliberations happen behind closed doors, so the public cannot verify who said what. One side says the holdout admitted doubt and stonewalled. He says he held a firm view and was interrupted. Only the jurors themselves know, and their versions cannot all be true.

Emotions around the case are running high. Judge Sullivan has indefinitely sealed the jurors’ identities and questionnaires, citing safety concerns after the high-profile mistrial. Whatever anyone thinks of the outcome, jurors who serve when called should not face threats for how they voted.

Desronvil has supporters. A lawyer who says he represents him has praised him as an “American Hero.” His brother has also said publicly that he looked at the case and made his call.

Unanimity is the rule for a reason. The system requires twelve people to agree beyond a reasonable doubt, and it is designed so that one conscientious juror can stop a verdict he does not believe the evidence supports. Critics of the holdout say that principle does not protect someone who ignores the law’s instructions, and the accounts of what happened in that room conflict.

The children at the center of the case are easy to lose in the argument over process. Three young lives ended in their family’s home, and the district attorney has said he wants justice for them. That is the standard prosecutors will apply to whatever they decide next.

Plymouth County prosecutors are weighing whether to retry Clancy, and her attorneys have floated resolving the case without another jury trial. District Attorney Timothy Cruz said no retrial decision would be made on the day of the mistrial.

Legal commentator Jonathan Turley says prosecutors must decide whether they could ever persuade a jury, particularly in Massachusetts, to unanimously reject the insanity defense. He says walking away is also an unappealing choice given three dead children.

Legal analyst Neama Rahmani says prosecutors face an uphill battle in a retrial, with 11 jurors having sided with the defense, but that a plea deal remains unlikely.

A mistrial is not an acquittal and does not decide guilt or innocence. Nothing in this case has been resolved, and a new jury would have to be seated from a community that has followed the story closely.
